On what grounds would he have a case? In this case Ruff has no constitutional right to play basketball and the school has the right to suspend him based soley on the arrest. The school has not come out against him or slandered him, the school has not defamed his character. I talked to a few lawyers tonight and none of them though Ruff would have case based on what has happend so far. The Duke case is alot different than this one for alot of reasons.
 
This is hurting Ruff's future on where he will play next.So it is costing him alot of money if he is found not guitly or charges are dropped he has a good case.

The "this" you are refering to is him being arrested and having it be a semi-national story. The school is a private institution of which Ruffin is a student who can be suspended for being arrested. If a biology student was arrested for this same charge and suspended pending an internal investagation would he be able to sue later becasue the suspension hurt his chances of getting into medical school? Well he could sue but he would not win and would have a very hard time proving damages. Ruffin would have an even harder time proving damages and has no case agaist the school for simply suspending him weather he is found guilty or not.
 
Its pathetic seeing all the wise acres spinning their posts to back DR now or act as though they have been "neutral." They still want to couch everything in conjecture. How about posting an apology instead.

If there's anything I think we'd agree on it is that ....

---anyone can sue anyone, it's the American way
---even the most astoundingly weak cases still seem to have the ability to get to court and even win sometimes.
---and even the most ludicrous cases sometimes get favorable rulings despite enormous public opinion to the contrary
--and just about the time even the most informed legal expert thinks he has a case figured out or knows how a case will turn out, the facts prove him laughingly wrong,
eg....OJ Simpson, and many others, including the legions of people who successfully get plastic surgery then don't like the way they look afterwards.
 
And don't forget, you don't have to have a winnable case to cash in big with a lawsuit. It happens in the majority of lawsuits. Because of the way the US tort system is based, a huge number of lawsuits are settled by an innocent defendant paying out large sums to the plaintiff just to avoid huge legal coasts of defending a lawsuit that would never stand a chance of winning. And public institutions, like Bradley, will often settle non-winnable cases out of court, just to avoid the bad publicity the case may bring.

No one is hurt worse by those lawsuits than doctors. Other examples are the burgalur who sues you after he gets hurt robbing your house. That is a real case where the burgalur won a lot of money.
 
I think what I enjoyed most about yesterday's whole Phil experience was his ranting about everyone looking the other way when the basketball players were bad, followed by his sound radio endorsement of underage drinking by his intern, who, though a BU student, could be considered a public personality because of her weekly appearances on his radio show.
 
People wonder why the JStar is going broke.Writers like him who don't do there homework and get about half of the story.
